Getty Images Key Facts Trump was originally named as a defendant in the New York attorney general Letitia James’ lawsuit, which accuses the ex-president, his business associates—including his children—and Trump Organization of fraudulently inflating the value of their assets on financial documents to obtain more favorable business deals and boost the former president’s net worth. An appeals court dismissed Ivanka Trump from the case in June, ruling the claims against her in the lawsuit, from before she left the Trump Organization in early 2017, were barred by the statute of limitations.

James’ office is still trying to get her to testify at the trial, issuing subpoenas to multiple corporate entities associated with the ex-president’s daughter. In a filing Thursday, Ivanka Trump’s attorneys asked the court to throw out those subpoenas, arguing she wasn’t properly served and the state court lacks jurisdiction because she’s not a New York resident anymore. Ivanka Trump also isn’t relevant to the case anymore, her attorneys argued, after Judge Arthur Engoron issued a summary judgment ruling before the trial that found her father and other business associates liable for fraud , narrowing the scope of what would be determined at the trial.

In an email submitted to the court, the attorney general’s office said it would file a motion Friday to compel Trump’s appearance. The case asks the court to impose widespread penalties on the Trump family and their business, including canceling business certificates—which Engoron has already ordered —a $250 million fine and barring the defendants from running any New York companies. Before her father’s presidential inauguration, Ivanka Trump served as the Trump Organization’s executive vice president for development and acquisitions, which the James’s office noted included “direct[ing] all areas of the company’s real estate and hotel management platform. ” The initial lawsuit , from before Trump was dismissed from the case, alleges the president’s daughter was directly involved with some of the business deals that involved allegedly inflated valuations, including being responsible for loans that required submitting financial statements, and was “aware of, and knowingly participated in, the [fraud] scheme.
